Terms of Service

1. Acceptance of Terms

By accessing or using TenderClaw ("the Service"), including the API at api.tenderclaw.io and the Claude Code skill, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

TenderClaw provides an API and Claude Code skill for discovering government tenders, analyzing procurement opportunities, and generating bid documents. The Service aggregates publicly available tender data from government procurement platforms.

3. AI-Generated Content Disclaimer

All documents, proposals, budgets, scoring analyses, and emails generated by TenderClaw are drafts. You are solely responsible for reviewing, verifying, and approving all AI-generated content before submission to any procurement authority.

TenderClaw does not guarantee the accuracy, completeness, or compliance of generated documents. AI-generated scores, analyses, and recommendations are advisory only and should not be the sole basis for bidding decisions.

4. API Usage & Fair Use

Your plan determines your monthly API call allocation. Starter and Early Access plans include 500 calls/month. Pro plans include unlimited calls subject to fair use. Exceeding your limit returns HTTP 429 until the next billing cycle.

You may not: redistribute API data commercially, reverse-engineer the API, use automated systems to exceed rate limits, or resell API access without a Custom plan agreement.

5. Accounts & API Keys

Your API key is your identity. Keep it confidential. You are responsible for all activity under your key. If you suspect unauthorized use, contact us immediately and we will rotate your key.

6. Payment & Billing

Subscriptions are billed monthly via Stripe. All fees are non-refundable except as required by law. Failed payments result in a grace period, after which API access is suspended. You can manage your subscription at tenderclaw.io/billing.

7. Termination

You may cancel your subscription at any time. We may suspend or terminate your access for violation of these Terms, abuse of the API, or non-payment. Upon termination, your API key is deactivated. Locally stored data (profile, pipeline) remains yours.

8. Limitation of Liability

TenderClaw is provided "as is" without warranty of any kind. We are not liable for any damages arising from: reliance on AI-generated content, missed tender deadlines, inaccurate scoring, API downtime, or data source unavailability. Our total liability is limited to the amount you paid in the 3 months preceding any claim.

9. Data Sources

TenderClaw aggregates publicly available data from government procurement platforms (SAM.gov, TED EU, Contracts Finder, etc.). We do not guarantee completeness or real-time accuracy of tender data. Official source platforms remain the authoritative record.

10. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email.
